Business in Slovakia

Temporary residence for the purpose of business shall be granted by a police department, if there are no reasons for the refusal of the application to a third country national who

a) is or will be conducting business in the Slovak Republic as a natural person; or

b) is or will be acting on behalf of a trading company or cooperative and is not in an employment relationship.

A police department shall grant temporary residence for the purpose of business for the assumed time period of business, but for a period no longer than three years.

Employment in Slovakia

Temporary residence for the purpose of employment shall be granted to a third country national by a police department, if there are no reasons for the refusal of the application based on a confirmation of the possibility to fill a vacancy.

A police department shall also grant temporary residence for the purpose of employment, if there are no reasons for the refusal of the application to a third country national who has an employment permit or to a third country national who is not required to have an employment permit  or a confirmation of the possibility to fill a vacancy.

 A police department shall grant temporary residence for the purpose of employment for the assumed duration of employment, but for a period no longer than five years.

Temporary residence for the purpose of seasonal employment may be granted by a police department to a third country national under the conditions laid down in par. 1 for a maximum of 180 days during 12 consecutive months. If the validity of the travel document of a third country national is less than 180 days, the police department shall grant temporary residence for a period not exceeding the validity of the travel document. The total period for which the police department may grant temporary residence for the purpose of seasonal employment shall also include the period of no more than 90 days, during which the third country national pursued seasonal employment.

Temporary residence for the purpose of employment, in the event of intra-corporate transfer, may be granted by a police department to a third country national according to par. 1 for a period no longer than three years in case of a manager or specialist45a, and for a period no longer than one year in case of an employee – trainee .

Temporary residence for the purpose of employment is not required for stays of less than 90 days from the beginning of the residence in the Slovak Republic, if a third country national fulfils the conditions for residence under a specific regulation and

 a) works for an important foreign investor  in the Slovak Republic;

b) has been posted by his/her employer based in a Member State to the Slovak Republic in the framework of services provided by such employer;

c) is employed in international public transport, provided that he/she has been posted by his/her foreign employer to work in the territory of the Slovak Republic49);

d) is employed for a specified period for the purpose of his/her training, provided that he/she pursues employment with the lack of workforce and has applied for temporary residence for the purpose of employment in the same job;

 e) provides for the supply and delivery of goods or services based on a commercial contract or, in relation to the supply of goods, he/she performs installation works, warranty and repair works, works related to the setup of production facility systems, programming works or specialized training, if the duration of his/her posting does not exceed the total of 90 days a year;

 f) provides for the supply and delivery of goods or services based on a commercial contract for a trading company to which investment aid has been granted under a specific regulation, and in relation to the supply of goods he/she performs installation works, warranty and repair works, works related to the setup of production facility systems, programming works or specialized training for the period for which a decision approving the investment aid was issued;

 g) pursues seasonal employment; or

h) provides specialized trainings for a corporate service centre, if the duration of his/her employment relationship with the corporate services centre does not exceed the total of 90 days in a calendar year.
